Don’t Ignore Compliance- It Won’t Ignore You

The Information Commissioner’s Office has fined businesses more than £2 million pound in the last two years, due to breaches in compliance procedures.

The government’s data protection regulator, known as the ICO, issued 49 monetary penalties including a recent £400k fine to telecommunications giant Talk Talk.

Small businesses are often expected to lose grip when regulating their own procedures, a lack of internal resource or specialist knowledge perhaps. But it is clear the big boys have not mastered the process either.

Big organisations are among those fined, with Hampshire County Council, Blackpool Teaching Hospitals NHS Trust and Telegraph Media Group joining the list of non-compliant companies.

On the back end of a law change in April 2015, the ICO is making it easier to crack down on unsolicited calls made to businesses and consumers.

The ICO has previously had to prove `substantial damage or substantial distress` as a result of spam calls and texts, but now proving a serious breach of the Privacy and Electronic Communication Regulations will do.

A blow to business bank accounts is not the only mark the ICO is making, with tarnished reputations and a stream of negative press following each penalty, enforcement notice or written undertaking.

Within the same two year stint, the regulators served 32 enforcement notices to brands such as MI Wealth Management and Cheshire West & Chester Council.

In addition, 77 written undertakings were secured from the likes of British Red Cross and Student Loans Company.
